Government to form committee to study, offer resolutions to stalled housing projects

The government is planning to set up a committee to assess various aspects of several stalled
housing projects across the country that were launched before the enactment of Real Estate
(Regulation & Development) Act, 2016 (RERA).
The committee will provide a resolution and propose a future course of action to ensure that
homebuyers get delivery of their homes in these stalled projects, the Ministry of Housing &
Urban Affairs (MoHUA) said.
The decision to form the committee for this purpose was taken at the third meeting of
the Central Advisory Council (CAC) constituted under the RERA. The meeting was held today
under the chairmanship of the Minister of Housing and Urban Affairs Hardeep Singh Puri.
The minister reiterated the resolve and commitment of the government of India to protect the
interest of homebuyers and ensure continued transparency and accountability in the real estate
sector through effective implementation of RERA.
ET had reported the government’s plan to form a committee to provide resolution on such
stalled housing projects on March 30.
The advisory council discussed issues related to Implementation status of RERA by States and
Union Territories (UTs); modifications in the rules framed by States and UTs; strengthening
RERA to ensure its effective implementation; structural safety of the projects; and Constitution
of Committee for resolution of legacy stalled projects.
The committee has decided that the meeting of the council will be held at least once in a year, a
sub-group consisting of concerned stakeholders will meet once in 6 months, under the
chairmanship of Secretary, MoHUA.
Homebuyers across the country have been raising concerns over dilution of RERA rules by
states especially considering that authorities are unable to enforce their own orders.
Based on the feedback, the government has decided to take action to ensure implementation of
RERA in letter & spirit by establishing permanent Regulatory Authorities and Appellate Tribunals
across the country.
It will also undertake a detailed examination of reasons behind non-implementation of orders
passed by Regulatory Authorities/Adjudicating Officers regarding refund, penalty, compensation
etc.
Regarding the issue of structural safety of projects, it was decided that the development
authorities may ask for a structural safety certificate from site engineer and promoter at the time
of applying for completion certificate. It was decided to take the matter with State Governments
in respect of forthcoming projects.
The committee has decided to approve the registration of real estate agents on Pan-India basis.
In this regard, matter will be taken up with the state governments to finalize the modalities for
the same.
